Terms of Attendance

Attendance at and participation in the Health and Longevity Forum St. Moritz 2024 (the “Forum”) by applying for the Forum means you agree to these terms, which form a legally binding contract between the HL Forum GmbH (“Organizer”) and the applicant, attendee, participant (“you” or “Attendee(s)”).

If you are registering on behalf of another individual, we may assume that you act as a duly authorized representative of such an individual and that your acceptance of the Terms of Attendance will be legally binding for that person. It is your responsibility to ensure that the person attending is aware of these Terms of Attendance. By completing the “Reserve your Spot” form on behalf of another individual, you warrant that you have made the attendee(s) aware of these Terms of Attendance and that they have accepted them.

  1. Attendee Requirements & Conditions

    • Application. Your application does not entitle you to admittance to the Forum for which you have registered. Your application will be reviewed by the Organizer. Only once you have received the official acceptance email are you admitted to the Forum. The number of attendees is limited, and admittance is only available by completing the “Reserve your Spot” form on the Organizer’s website.
    • Forum Content. You acknowledge and agree that the Organizer, in its sole discretion, reserves the right to change any and all aspects of the Forum, including, but not limited to, the Forum name, themes, content, program, speakers, performers, hosts, moderators, venue, and time.
    • Identification. All attendees must provide an acceptable form of identification upon request: government-issued photo ID, passport, or other photo ID.
    • Substitution. The application is binding for the Attendee. If an Attendee is canceling his participation, the ticket fees or any other compensation are neither refundable nor does the Attendee have the right to transfer the ticket (seat reservation) to next year’s Forum. The Organizer may permit or refuse a substitution request at its sole discretion after review of the request and the substitute. An Attendee’s request for substitution of his or her acceptance and attendance by someone else must contain the relevant personal information on the substitute and be made in writing to the Organizer at least 10 days prior to the Forum. However, in case of approval of a substitution request by the Organizer, the Attendee has no right to a refund of the ticket fee.
    • Non-participation of an Attendee. If an attendee does not attend the Forum for whatever reason(s), the attendee has no right to a refund of the ticket fee nor the right to transfer the ticket to the next year’s Forum. Furthermore, the non-participating attendee has no right to a refund of the ticket fee, even if the Forum is fully sold out.
    • Denial of Admission. The Organizer reserves the right to deny admission to the Forum on the grounds of valid reasons. Examples of valid reasons include: intoxicated condition of a visitor, offensive or inappropriate clothing or behavior, or the carrying of dangerous objects. In the case of denial of admission based on a valid reason, the Attendee shall not be entitled to a refund of the ticket fee or any other compensation incurred by the Attendee in connection with the Forum.
    • Badge and personal entry card. Admission to the Forum is only granted with a valid badge and a personal entry card. The badge and the personal entry card have to be presented at the entrance. Attendee badges and the personal entry card must be worn and presented at all times in the Forum areas. In case the attendee loses his or her badge and/or the personal entry card during the Forum, he or she may purchase an additional badge and/or the personal entry card for CHF 250 from the organizer by presenting themselves to the main registration desk and showing proper identification.
    • Exclusion. The Organizer reserves the right to exclude, in its sole discretion, any prospective attendee from applying for or attending the Forum. The Organizer also reserves the right to cancel, in its sole discretion, the attendee’s acceptance upon refund of the admission fees paid to the Organizer. However, if the attendee’s acceptance is canceled for violating these Terms of Attendance, the Organizer may retain any or all fees paid.
  1. Admission Fees & Costs

    • Payment. The payment of the applicable fees for the Forum is due upon submission of your application. If such payment is insufficient, delayed, or declined for any reason, the Organizer may delay or refuse the review of the application and shall have no liability whatsoever.
    • Taxes. The applicable fees may be subject to sales tax, value added tax, or other applicable taxes and duties. If such taxes and duties are applicable, they will be charged in addition to the fees as indicated on the application forms.
    • Payment Method. The applicable fees shall be remitted via bank transfer.
    • Other Costs. Any and all costs associated with your application and attendance (including, but not limited to, travel and accommodation expenses) shall be borne solely by the Attendee. The Organizer shall have no liability for such costs, even if the Forum is canceled or your admission to the Forum is denied for any valid reason.
  1. Cancellation of the Forum

    • Force Majeure

      Cancellation in full
      . The Forum may be cancelled in full at any time before the start of the Forum without prior notice due to any Act of God or Force Majeure, including, without limitation, weather, fire, flood, labor disputes, epidemics, pandemics, disease outbreaks, public health crises, states of emergency, earthquakes, wars, civil or military disturbances, acts of terrorism, sabotage, strikes, riots, power failures, transport obstructions, accidents, acts of civil or military authority, acts of government, or inability to obtain necessary labor, material, equipment, or transportation, or similar causes beyond the control of the Attendees or Organizer.

      Cancellation in part
      . The Forum may be cancelled in part at any time before or after the start of the Forum without prior notice due to any Act of God or Force Majeure, including, without limitation, weather, fire, flood, labor dispute, epidemics, pandemics, disease outbreak, public health crisis, state of emergency, earthquakes, wars, civil or military disturbances, acts of terrorism, sabotage, strikes, riots, power failures, transport obstructions, accidents, acts of civil or military authority, acts of government, or inability to obtain necessary labor, material, equipment, or transportation, or similar cause beyond the control of the Attendees or Organizer.
  • Cancellation.
    • Cancellation in full. In case of the cancellation of the Forum in full for any of the reasons set forth in Section 3.1.1, the Attendee is entitled to transfer the seat reservation to next year’s Forum but not to a refund of the admission fee paid or any other compensation incurred by the Attendee in connection with the Forum.
    • Cancellation in part. In case of the cancellation of the Forum, in part, at any time before or after the start of the Forum for any of the reasons set forth in Section 3.1.2, the Attendee is entitled to a partial refund as follows:
      • If the Forum is canceled on the first day of the Forum, the Attendee shall be entitled to a partial refund in the maximum amount of 25% of the ticket fee.
      • If the Forum is canceled on the second day of the Forum, the Attendee shall be entitled to a partial refund in the maximum amount of 10% of the ticket fee.
      • If the Forum is canceled on the third day of the Forum, the Attendee shall not be entitled to a partial refund.
  1. Image Rights / Right to Forum Content / Collection an Use of Data

    • Use of Likeness. By attending the Forum, you acknowledge and agree to grant Organizer the right to record, film, photograph, or capture your likeness at the Forum. You hereby grant Organizer the irrevocable right to use, reproduce, distribute, broadcast, or otherwise disseminate your likeness in any media now available or hereafter developed, globally and in perpetuity, without any further approval from you or any payment to you. This grant includes, but is not limited to, the right to edit such media, to use it alone or in conjunction with other information, to offer it for sale to other attendees and the general public, and to authorize others to use or disseminate the media.
    • No Right to Forum Content. Except for rights existing prior to the Forum, you shall not possess or obtain any entitlement to presentations, discussions, inventions, designs, plans, names, technologies, or ideas expressed, discussed, or conveyed during the Forum. Any utilization of copyrighted material by the Attendee shall be confined to those explicitly authorized in writing within said material. In the absence of such explicit authorization, the Attendee may not employ any copyrighted material for any purpose without explicit written consent from the copyright owner.
    • Collection and Use of Data. By registering for the Forum, you acknowledge and consent to the Organizer’s collection and processing of personal data, if necessary for contact tracing purposes. You further confirm that you have reviewed and agreed to the terms outlined in the Privacy Policy and the Terms of Use available on the Organizer’s website.
  1. Forum Policies

    • Compliance with Laws and Regulations. Attendees are required to adhere to all pertinent laws, regulations, and directives issued by governmental entities, as well as the regulations outlined by the Organizer and the proprietor or manager of the venue hosting the Forum. Attendees are obligated to adhere to directives provided by Forum personnel, venue staff, and security personnel.
    • Commercial Activities by Attendees. Attendees are expressly prohibited from engaging in any commercial activities, including but not limited to sales, advertising, or solicitation of business from other Attendees or exhibitors, unless such activities have received prior written consent from the Organizer.
    • Disruptive Conduct. You hereby acknowledge and consent that the Organizer retains the authority to expel you from the Forum, at its sole discretion, should it determine that your presence violates any legal provisions, or that your conduct poses a disruption or safety hazard to yourself or others, or if it impedes the proper functioning of the Forum or diminishes the experience of other attendees, Forum staff, speakers, sponsors, and/or exhibitors.
    • Photography, Recording, Live Streaming. Attendees are prohibited from recording, broadcasting, live streaming, or videotaping any sessions at Organizer Forums. However, attendees may take pictures within the event for personal use only. Any use of such pictures for purposes other than personal use, including but not limited to commercial purposes, is strictly prohibited.
    • No Disparagement. Attendees agree not to make any disparaging, defamatory, or slanderous remarks, directly or indirectly, in any form of media, about the Organizer or any of its associates, employees, agents, shareholders, assigns, or contractors, or about any other attendees, speakers, sponsors, or parties associated with the Forum.
  1. Limitation of Liability & Indemnification

    • Organizer is responsible for the administrative organization of the Forum solely. The Organizer is solely responsible for the administrative organization of the Forum. The Organizer does not assume any responsibility for, nor make any statement (implied or express) regarding the content, information presented, opinions expressed, or products, services, or investments offered during the Forum. Specifically, by inviting or admitting any Attendee, speaker, or other partner, the Organizer does not make any statement or recommendation regarding such individuals, their statements and opinions, or the services, investments, or business conducted by them.
    • The Organizer, its shareholders, officers, directors, employees, agents, independent contractors, or representatives shall not be liable for any injury, loss, or damage, including special, incidental, indirect, consequential, or punitive damages, incurred by Attendee, Attendee’s agents, employees, affiliated personnel, officers, directors, shareholders, contractors, or representatives, or any of their property, businesses, or activities, from any cause whatsoever, before, during, or after the Forum, and such liability is waived to the fullest extent. If such waiver is not fully enforceable under applicable law, liability shall not exceed the fees paid by the respective Attendee.
    • By registering for the Forum, Attendee assumes all risks and releases, indemnifies, defends, and holds harmless the Organizer and its              shareholders, officers, directors, employees, agents, independent contractors, and representatives from all claims for loss, injury, or damages. Attendee also releases and discharges the Organizer and its shareholders, officers, directors, employees, agents, independent contractors, and representatives from all liabilities arising from the selection, rejection, or removal of Attendee from the Forum and the enforcement of the Terms of Attendance. Attendee further agrees to indemnify, defend, and hold harmless the Organizer and its shareholders, officers, directors, employees, agents, independent contractors, and representatives from any losses, damages, suits, claims, causes of action, liabilities, expenses, costs, and attorneys’ fees arising from Attendee’s infringement of intellectual property rights or other rights of any third party, or of Attendee’s agents, employees, affiliated personnel, officers, directors, shareholders, contractors, or representatives.
  1. Agreement, Governing Law & Jurisdiction

  • Acknowledgement and Acceptance | Amendments to the Terms of Attendance. The Attendee agrees to adhere to the foregoing terms, conditions, and rules, as well as any additional terms, conditions, and rules established by the Organizer from time to time for the efficient, enjoyable, and safe operation of the Forum. These additional terms are inclusive of, but not limited to, those contained in these Terms of Attendance. The Attendee acknowledges that they will not receive notification via email or any other means regarding amendments to these Terms of Attendance. It is the Attendee’s responsibility to periodically check our website and review the Terms of Attendance before each registration. There exists no other agreement or warranty between the Attendee and the Organizer except as outlined in this document and any accompanying addenda or exhibits. The headings utilized in these Terms of Attendance are for organizational purposes solely and shall not be construed in the interpretation of the substance of these Terms of Attendance. The rights of the Organizer under these Terms of Attendance shall not be considered waived unless explicitly stated in writing and signed by an authorized representative of the Organizer.
  • Governing Law & Jurisdiction. These Terms of Attendance and any dispute, controversy, or claim arising from or related to these Terms of Attendance shall be governed by and interpreted in accordance with the substantive laws of Switzerland, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive jurisdiction for any dispute, claim, or controversy arising from, related to, or connected with these Terms of Attendance (or subsequent versions thereof), including but not limited to disputes, claims, or controversies regarding their existence, validity, interpretation, performance, breach, or termination, shall lie with the canton of Zurich, Switzerland.
